AN ACT relating to unauthorized aliens. Create a new section of KRS 337 to prohibit an employer from hiring an unauthorized alien; amend KRS 337.990 to impose a penalty as prescribed in 8 U.S.C. sec 1324a, and provide an exemption to an employer who verifies the immigration status of newly hired employees through a federal work authorization program administered by the United States Department of Homeland Security.

AN ACT relating to employment of unauthorized aliens.  Create a new section of Chapter 141 to prohibit a deduction for wages paid to an unauthorized alien; require withholding on all payments to an unauthorized alien; provide that the section is effective for tax years beginning after December 31, 2008.

AN ACT relating to public contracts. Create new sections of KRS Chapter 45A to define "Basic Pilot Program," "contract," "contractor," "governmental body," "local public agency," and "unauthorized alien"; require contractors to verify employment eligibility of all employees by registering and participating in the Basic Pilot Program operated by the United States Department of Homeland Security; require the cabinet to promulgate administrative regulations relating to certification and registration requirements with the Basic Pilot Program; provide that failure to comply results in cancellation of contract and disqualification of contract eligibility for five years.

AN ACT relating to government contracts. Amend KRS 45A.480 and 176.085 to require, as a condition for being awarded a state contract, that a person, contractor, or subcontractor is registered and participating in a federal work authorization program to verify employment eligibility of employees pursuant to the federal Immigration Reform and Control Act of 1986; impose fine of $4,000 for violation; and provide that violation shall be grounds for cancellation of contract and disqualification for future contracts for 5 years.
