Bene v. Kassulke (1977)

Female inmates filed suit over discriminatory conditions in Jefferson County Jail. Male prisoners were given preferential treatment in the allotment of space, mobility, within the jail and food and access to work release programs.

Challenged state legislation passed after Roe that required biased state - mandated counseling, spousal consent, parental consent, and a ban on saline solution procedure, the only procedure available for some terminations.
