Along with the national ACLU's Women's Rights Project and Reproductive Freedom Project, we filed briefs in the trial and appeals courts in the criminal prosecution of a pregnant drug abuser. We successfully argued that based on a Kentucky Supreme Court decision in Commonwealth v. Welch - the child abuse statues do not apply to dangerous prenatal conduct.
